1. About These Terms

These Terms of Service govern your use of the Toffee app and website at toffeefinance.com, operated by Toffee Finance Inc., 833 Grand Teton Dr, Plano, Texas 75023, USA (hello@toffeefinance.com).

By using Toffee, you agree to these terms. If you are a consumer in the United Kingdom, these terms are subject to English law to the extent applicable, and nothing in these terms affects your statutory rights under UK law, including the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

2. Not Financial Advice

Important notice for UK users

Toffee is a debt tracking and planning tool only. It is not financial advice and must not be relied upon as such. Debt-free date calculations, interest projections, and payoff estimates are based on data you enter and are estimates only — actual outcomes will vary based on your lenders' terms, interest rate changes, missed payments, and other factors.

Toffee Finance Inc. is not authorised or regulated by the Financial Conduct Authority (FCA). Toffee does not provide regulated financial advice, debt management services, or credit broking. For free, impartial money guidance, visit MoneyHelper.org.uk (a government-backed service).

3. The Service

Toffee offers a subscription app with a 14-day free trial. Subscription pricing is displayed at the point of purchase in the App Store or Google Play. We reserve the right to modify features or adjust pricing with reasonable prior notice to subscribers.

4. Your Right to Cancel (UK Consumers)

Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, if you are a UK consumer you have the right to cancel within 14 days of purchase without giving any reason (the "cooling-off period").

However, by starting your free trial or accessing premium features immediately, you expressly request that we begin providing the digital service before the 14-day period ends. If you later exercise your right to cancel during that period, we may charge a proportionate amount for the portion of the service already delivered.

How to cancel: Use the subscription management section in the App Store (iOS) or Google Play (Android), or email hello@toffeefinance.com. After the 14-day period, cancellation takes effect at the end of your current billing period; no refund is issued for unused time within a paid period.

5. Consumer Rights Act 2015

Our service is provided with reasonable care and skill as required by the Consumer Rights Act 2015. If the service does not meet this standard, you may be entitled to a repeat performance or a price reduction. Nothing in these terms excludes or limits your rights under the Consumer Rights Act 2015 or any other mandatory UK consumer protection law.

6. Acceptable Use

You agree to use Toffee only for lawful, personal, non-commercial purposes. You must not attempt to reverse-engineer, decompile, or extract source code from the app; use the service to store or process unlawful content; or attempt to gain unauthorised access to any part of our systems. You are responsible for maintaining the security of your account credentials.

7. Intellectual Property

All content, branding, software, and functionality within Toffee is owned by or licensed to Toffee Finance Inc. You are granted a personal, non-exclusive, non-transferable licence to use the app for your own personal debt tracking purposes. No other rights are granted.

8. Limitation of Liability

To the maximum extent permitted by applicable law, our total liability to you for any claim arising from your use of Toffee is limited to the amount you paid for the service in the 12 months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive losses, loss of data, or loss of profits.

These limitations do not apply to: liability for death or personal injury caused by our negligence; liability for fraud or fraudulent misrepresentation; or any liability that cannot be excluded or limited under the Consumer Rights Act 2015 or other applicable law.

9. Third-Party Links

Toffee may contain links to third-party websites or services. These links are provided for convenience only and do not constitute an endorsement. We have no control over and accept no responsibility for the content, privacy practices, or availability of third-party sites.

10. Governing Law and Disputes

For UK consumers, these terms are governed by the laws of England and Wales to the extent that they do not reduce your mandatory statutory rights. If a dispute arises, we encourage you to contact us at hello@toffeefinance.com so we can attempt to resolve it informally.

UK consumers may also use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

11. Changes to These Terms

We will give at least 30 days' notice of material changes to these terms via the app or email. Continued use of Toffee after the effective date of updated terms constitutes your acceptance of those changes. If you do not agree to the changes, you may cancel your subscription before they take effect.
